The applicant failed to demonstrate that the order that stayed the proceedings in which the individual case was decided, in which the allegedly unconstitutional statutory provision was to be used, is final. As the procedural requirement for deciding on the constitutionality of the challenged regulation determined by Article 156 of the Constitution and the first paragraph of Article 23 of the Constitutional Court Act is not fulfilled, the Constitutional Court rejected the applicant's request on the basis of the first paragraph of Article 25 of the Constitutional Court Act.
