Abstract:
In the circumstances of the case at issue, the standpoint of the courts that the complainant’s claims for damages were time-barred entails a disproportionate limitation of the complainant’s right to compensation guaranteed by Article 26 of the Constitution. The overly strict interpretation of the courts regarding the onset of the subjective limitation period and disregard for the concept of the suspension of the limitation period demonstrate that the courts did not adapt their review to the special circumstances affecting the so-called erased persons.
