Abstract:
The positions of the Higher Court and the Supreme Court regarding the time-barring of claims for damages due to the unlawful conduct of the state (erasure from the register of permanent residents) is unacceptable from the viewpoint of the constitutional requirement that, with respect to the circumstances of the individual case, the court must apply the rules regarding limitation periods in such a manner that the filing of the remedies that are available to a party is not rendered disproportionally difficult or even prevented.
