The legal classification of the minor offence as stated in the charge sheet is manifestly erroneous. Due to the fact that only a fine is prescribed for the minor offence that the defendant is accused of, and the other participant suffered merely damage to property, a road traffic accident is deemed insignificant. As regards the above-mentioned, the conditions for imposing the secondary sanction of disqualification from driving in accordance with Article 234 of the Road Traffic Safety Act are not fulfilled, therefore the minor offence authority is competent to decide the minor offence proceedings.
