Due to the fact that in appellate proceedings the Supreme Court dismissed an action without taking a position on the allegations stated in the action that are essential for the decision on the correctness of the challenged decision of the Ministry of the Interior, it did not meet the requirement that a judicial decision be substantiated. Thereby, it violated the right to the equal protection of rights determined in Article 22 of the Constitution.
