In cases in which a minor offence decision is based on the incriminating statements of witnesses, in proceedings for deciding on a request for judicial protection an offender must be given an opportunity to examine these witnesses or require that they be examined. In cases in which in proceedings for deciding on a request for judicial protection an offender could not exercise this right, a judgment cannot be exclusively or to a decisive extent based on their statements.
