If a court does not take a position on the allegedly unconstitutional statutory regulation which was a legal basis for the challenged decision, it violates the right to the equal protection of rights determined in Article 22 of the Constitution. As the Supreme Court judgment is based on a statutory provision which the Constitutional Court established was inconsistent with Article 18 of the Constitution, thus also the Supreme Court judgment is inconsistent with this provision of the Constitution.
